Terms and Conditions

It is a precondition of use of this website that you fully comply with these terms and conditions each time you purchase a policy.
Definitions
Authorised User: Any solicitor, licensed conveyancer or legal executive who has registered with L&C to be a user of ci online and who has, or whose firm has, a professional indemnity policy in place, and is:
 
(i) a company limited by shares or a limited liability partnership which is recognised by the Law Society as a suitable body to provide legal services which is regulated by the Solicitors Regulation Authority,

or
  a licensed conveyancing company recognised by the Council for Licensed Conveyancers as a suitable body to provide legal services which is regulated by the Council for Licensed Conveyancers
AND who is, or whose firm is:
(ii) authorised and regulated by the Financial Conduct Authority (FCA) in respect of non-investment insurance contracts, or
  regulated in respect of insurance mediation activity by a Designated Professional Body as defined under Section 326 of the Financial Services & Markets Act 2000 (such as The Law Society) and recorded on the exempt professional firms register maintained by the FCA as such.
ci online: This website and all of its content.
Insurer: As stated in the Policy Summary and Policy Wording.
L&C: Legal & Contingency Limited.
Policy Summary(ies): Any policy summary appearing on ci online.
Policy Wording(s): Any policy wording appearing on ci online.

1. Acceptance of Terms
1.1 You, the Authorised User, are permitted by L&C to access and use ci online subject exclusively to these Terms and Conditions.
1.2 You will only use ci online in accordance with these Terms and Conditions and not for any purpose that is unlawful or prohibited.
1.3 By using ci online you are fully accepting the terms, conditions and disclaimers contained herein.
1.4 If you do not accept these Terms and Conditions you must immediately stop using ci online.

2. Changes to ci online
L&C reserves the right to:
2.1 change or remove (temporarily or permanently) ci online or any part of it without notice and you confirm that L&C shall not be liable to you for any such change or removal; and
2.2 change these Terms and Conditions at any time, and your continued use of ci online following any changes shall be deemed to be your acceptance of such change.

3. Restriction or Termination of your access to and use of ci online
L&C reserves the right to restrict or refuse access to all or part of ci online at any time, and without notice or explanation.

4. Regulatory
4.1 Users of ci online must be an Authorised User or an individual working under the supervision and with the authority of such Authorised User.
4.2 ci online insurance policies are underwritten by the Insurer.
4.3 You are acting for your clients and not as an agent of L&C in obtaining any quotation or the collection of any premium payments.
4.4 ci onlineinsurance policies are available for your use on the understanding that all relevant searches and enquiries have been made in accordance with normal conveyancing practice, including (but not limited to) searches of the Land Registry, Land Charge and Local Authority. This does not apply to any search to be covered under any Search Insurance product that can be purchased on ci online.
4.5 Before you purchase an insurance policy on ci online you must ensure that:
 
4.5.1 you comply with all the underwriting criteria and the terms and conditions as notified to you on ci online;
4.5.2 you are familiar with the Policy Wording and the cover provided, and are satisfied that they meet your client’s needs;
4.5.3 a Policy Summary has been made available to the insured and that they are fully aware of the policy cover, including its terms and conditions. Policy Summaries are available on ci online; and
4.5.4 all material facts (i.e. those which might reasonably be considered likely to influence L&C’s decision to insure a risk) to the extent required by law applicable at the commencement of the policy have been disclosed to L&C.
4.6 You are not authorised to amend or vary the ci online insurance Policy Wordings, or backdate cover in any circumstances.
4.7 The limit of indemnity entered by you must not be less than the market value of the property at the commencement of the policy.
4.8 All premiums quoted on ci online include Insurance Premium Tax at the prevailing rate.
4.9 Quotes provided on ci online are only valid for 6 calendar months from date the quote is given.
4.10 A ci online insurance policy is in force once a download of the policy is made available to you subject to your compliance with clause 4.11 below. L&C will send you an email confirming that the policy has been incepted. If you do not receive this email or the details shown on the policy schedule are incorrect you must contact L&C immediately on 020 7397 4363
4.11 Once a ci online insurance policy has been incepted you must pay the premium and send copies of any other documentation requested on ci online to L&C within 10 working days. Failure to pay the premium or send any such documentation may result in the policy being voided ab initio by the Insurer.
4.12 L&C reserve the right to request further information from you for auditing purposes.
4.13 L&C hold all premiums received as agent for the Insurer.
4.14 L&C are authorised and regulated by the FCA.

5. Data Protection (for more details please refer to our Privacy Policy)
5.1 We and the Insurer process personal information in accordance with the General Data Protection Regulation ("GDPR"). We will process personal information we deem necessary to provide and administer legal indemnity insurance policies. It may be necessary for us to share personal information with third parties in order to provide and administer the policies purchased via this website and fulfil our legal and/or regulatory obligations.
5.2 We will only process personal information in accordance with the applicable data protection legislation. For further information on how we use personal information and the rights available in relation to this information, please see our Privacy Policy.

6. Security
6.1 ci online is a secure website. You may only access the secure areas once you have obtained a password from L&C (via this website).
6.2 L&C can refuse to issue you with a password at any time, and without offering any explanation. If you have been issued with a password, L&C can revoke your use of such password at any time without notice, and without offering any explanation.
6.3 Once you have been issued with a password you must not disclose it to anyone. If your password is revealed to a third party, whether deliberately or in error or otherwise, L&C will not be liable to you for any loss incurred. If you forget your password, or if you believe that someone else knows your password, you must notify L&C immediately. You may change your password from time to time and for whatever reason via ci online.
6.4 There may be email features within ci online, which we cannot guarantee as secure.
6.5 Information given to L&C via ci online will be used to provide the requested service, and may also be used to keep you informed of products and services which may be of interest. If you do not want the information provided to be used in this way, please let us know by emailing enquiries@conveyancinginsurance.co.uk with your full name and postal address.

7. Links to and from Third Party Websites
7.1 ci online may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that L&C are not responsible for the content or availability of any such sites.
7.2 Your website may only be linked to ci online with the prior written consent of L&C. We may not give consent, and do not have to offer any explanation where consent is refused. If consent is given, the consent may be made subject to conditions.

8. Copyright
8.1 All copyright, trade marks and all other intellectual property rights in ci online and its content (including without limitation the website design, text, graphics and all software and source codes connected with ci online) are owned by or licensed to L&C or otherwise used by L&C as permitted by law. L&C will pursue any unauthorised infringements of our rights.
8.2 You are allowed to use, download, obtain and print the information on ci onlinefor the purpose only to obtain quotes and purchase policies online. You may not otherwise extract or distribute material contained within ci online, or use the material and tools for any commercial benefit to yourself or others. If you wish to use ci online content for any other purpose, or in any other way, you must contact L&C to obtain our prior written consent. L&C may not give consent. If any consent is given L&C will explain, as part of the consent, how you will be permitted to use ci online and its contents.

9. Advice
The content of ci online does not constitute advice or a recommendation to you or to your client and should not be relied upon in making, or refraining from making any decision. You are responsible for providing proper advice to your client on the suitability of products and services advertised on ci online.

10. Disclaimers and Limitation of Liability
10.1 Whilst L&C endeavour ensure that the content of ci online is current and accurate, ci online is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to any warranties as to non-infringement, compatibility, security and accuracy and to the implied warranties of satisfactory quality and fitness for a particular purpose.
10.2 To the extent permitted by law, L&C will not be liable for any loss of business, opportunity, data or profits or for any indirect or consequential loss or damage of whatsoever nature arising out of or in connection with the use of ci online.
10.3 L&C will endeavour to make ci online constantly available for your use, however we make no warranty that the functionality of ci online will be uninterrupted or error free, that defects will be corrected or that ci online or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
10.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of L&C for death or personal injury as a result of the negligence of L&C.

11. Indemnity
You agree to indemnify and hold L&C and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against L&C arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of ci online, whether deliberate or negligent.

12.2 Our aim is to provide our customers with the highest standards of service. In the unfortunate event that we fail to meet your expectations, we operate a complaints procedure.

Many concerns can often be resolved straight away, therefore in the first instance please get in touch with your usual contact as they will be able to provide you with immediate assistance to help resolve any issues you may have.

We will try to resolve any complaint within 3 business days of receipt and will issue a written response to you within 5 business days of receipt following resolution.

If the matter is escalated or raised with the Compliance Officer, you can expect to receive an acknowledgment within 5 business days advising you who is dealing with the complaint and indicating when you may expect an answer. We will provide a response or an update as to the progress of our investigations within 14 calendar days of receipt of your complaint.

If further investigations or enquiries are necessary, and we are unable to provide you with a resolution and a formal written response within 4 weeks from receipt of the original complaint or if you remain dissatisfied with our response to your complaint,

a) if your policy has been underwritten by Certain Underwriters at Lloyd's you may if you wish, refer your complaint to Lloyd's. Lloyd's will investigate the matter and provide a final response. Lloyd's contact details are as follows:

b) if your policy has been underwritten by another insurer we will continue to investigate your concerns in line with our complaints procedure and provide a final response within 8 weeks.

At each stage of the process we will:

  • Advise you who is handling the complaint

  • Advise you when you should expect to receive a detailed response

  • Keep you advised of progress as matters develop

And

  • The outcome will be explained to you in detail with full reasoning.

  • You will be advised of any further redress available to you should you believe the matter has not been resolved to your satisfaction

Should you remain dissatisfied with our final response, or with Lloyd's final response, you may, if eligible, refer your complaint to the Financial Ombudsman Service. The Financial Ombudsman Service is an independent and impartial service in the UK for settling disputes between consumers and businesses providing financial services.

  The Insurer is covered by the Financial Service Compensation Scheme (FSCS). If the Insurer is unable to meet its obligations under a policy the insured may be entitled to compensation. You may contact the FSCS on 0800 678 1100 or 020 7741 4100 for further details.

13. Severance
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

14. Territories and Governing Law
14.1 The information and content of ci online is provided for the benefit of England and Wales only. ci online is not intended for your use if you, or your client, are resident outside England and Wales.
14.2 These Terms and Conditions, and your use of ci online, shall be governed by and construed in accordance with the laws of England and Wales and you hereby submit to the exclusive jurisdiction of the courts in England and Wales.
